Terms of Service

These Terms of Service ("Terms") are an agreement between you and Cirello ("Cirello," "we," "us," or "our"), operated by an individual based in Ukraine. They govern your use of all of Cirello:

  • The Site - cirello.app, including the blog.
  • The App - the Cirello application at web.cirello.app and the Cirello desktop and mobile apps.
  • The AI connector - the Cirello connector and plugin that let an AI assistant you choose work with your Cirello account.

Together these are the "Service". By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

How we handle personal data is described in our Privacy Policy.

1. The Service

Cirello is a spaced-repetition memory application. You create or import cards, and Cirello schedules them for review.

The Service is in beta. Features may change, be added, or be removed, and the Service may contain errors or be unavailable at times.

2. Eligibility

You must be at least 13 years old to use the Service. If you are below the age of majority in your country, you may use the Service only with the permission of a parent or guardian, who agrees to these Terms on your behalf.

3. Your Account

  • Give accurate information when you create an account and keep your email address up to date.
  • Keep your password secret. You are responsible for activity that happens under your account, including actions taken by an AI assistant you connected.
  • Tell us at [email protected] if you believe someone else has accessed your account.
  • An account is for one person. Do not create accounts by automated means.

4. Price

The Service is currently free and we do not ask for payment details. We plan to introduce a paid subscription later. If we do, we will tell you in advance, and you will not be charged unless you choose to subscribe.

5. Your Content

You own it. The cards, decks, images, notes, and other material you put into Cirello ("Your Content") remain yours.

Permission you give us. You give us permission to store, copy, process, and display Your Content only as needed to run the Service for you. This includes syncing it across your devices, scheduling reviews, creating audio from card text when you use the listening feature, and sending it to an AI assistant you connected. This permission ends when you delete the content or your account, except for text-to-speech audio already created, which is cached without any link to your account.

Your responsibility. You are responsible for Your Content. Only add material you have the right to use, and do not add material that is unlawful or that infringes someone else's rights.

Built-in decks. Starter decks provided by Cirello belong to Cirello and are licensed to you for personal study in the Service.

Export and deletion. You can download a copy of your data and delete your account at any time in the App under Account - Security.

6. Acceptable Use

You agree not to:

  • Use the Service for anything unlawful, or store unlawful or infringing content in it.
  • Try to access another person's account or data.
  • Probe, attack, or disrupt the Service, or get around its security or rate limits.
  • Scrape or collect data from the Service by automated means, other than through an AI assistant connected to your own account as these Terms allow.
  • Resell the Service or use it to build a competing service.
  • Upload malware or content designed to harm others.

7. AI Assistants and the Cirello Connector

You can connect an AI assistant (for example Claude or ChatGPT) to your Cirello account through the Cirello connector or plugin.

  • Your choice. Connecting is optional and happens only after you approve it on the Cirello consent screen, where you choose which permissions to grant.
  • It acts for you. A connected assistant acts on your behalf within the permissions you granted. Depending on those permissions it can read your library and statistics, create, edit, move, merge, and split cards, create and edit decks and folders, and delete cards. Changes it makes are treated as made by you.
  • Assistants make mistakes. AI assistants can misunderstand a request or produce incorrect content. Review what an assistant creates or changes. Deleting and merging cards cannot be undone, so grant the delete permission only if you need it.
  • Third-party service. The assistant is provided by another company under its own terms and privacy policy. We do not control the assistant, are not responsible for what it does or produces, and are not responsible for how its provider handles data you send to it.
  • Removing access. You can remove a connected assistant at any time in the App under Account - Security - Connected apps.
  • Limits. We may limit, suspend, or change the connector, including request rate limits, to protect the Service.

8. Third-Party Services

The Service uses or links to services run by others, such as Sign in with Google and our feedback board at feedback.cirello.app. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

9. Our Intellectual Property

The Service, including its software, design, text, graphics, logos, and built-in decks, is owned by or licensed to Cirello and protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify, or distribute any part of the Service, except Your Content, without our written permission.

10. Suspension and Termination

You can stop using the Service and delete your account at any time.

We may suspend or close your account if you seriously or repeatedly break these Terms, if we are required to by law, or if your use puts the Service or other users at risk. Where it is reasonable to do so, we will warn you first and give you a chance to export your data.

If we decide to shut down the Service, we will give you at least 30 days' notice so you can export your data.

11. Changes and Availability

We may change or discontinue any part of the Service. We aim to keep the Service available and your data safe, but during the beta we cannot promise uninterrupted availability. We do not keep separate database backups, so we recommend exporting your data regularly if it is important to you.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not promise that the Service will be uninterrupted, error-free, or secure, or that using it will produce any particular learning result. Cirello is a study tool and does not give professional, medical, or educational advice.

13. Limitation of Liability

To the fullest extent permitted by law, Cirello is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service or from the actions of a connected AI assistant. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.

Nothing in these Terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the law of your country.

14. Changes to These Terms

We may update these Terms. The new version will be posted here with a new "Last updated" date. If a change is material, we will tell you in the App or by email before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict of law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts of that country.
